Sesquatch is a product of Neapolitan LLC, a Wyoming limited liability company. By accessing or using Sesquatch ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Sesquatch is a platform for managing AWS Simple Email Service (SES) email templates. The Service allows users to create, edit, version, and deploy email templates to their AWS accounts.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- •Provide accurate and complete registration information
- •Maintain the security of your account credentials
- •Promptly update your account information as needed
- •Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use the Service to:
- •Violate any applicable laws or regulations
- •Send spam or unsolicited communications
- •Distribute malware or harmful content
- •Interfere with or disrupt the Service
- •Attempt to gain unauthorized access to any systems
- •Infringe on intellectual property rights of others
5. AWS Integration
The Service integrates with Amazon Web Services (AWS). You are responsible for:
- •Maintaining your own AWS account and credentials
- •Complying with AWS's terms of service and acceptable use policies
- •Any charges incurred through your AWS account
- •Properly configuring IAM roles and permissions
6. Subscription and Billing
Certain features of the Service require a paid subscription. By subscribing:
- •You authorize us to charge your payment method on a recurring basis
- •Charges will appear as "SESQUATCH" on your bank or credit card statement
- •Subscription fees are non-refundable except as required by law
- •You may cancel your subscription at any time
- •Price changes will be communicated in advance
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Sesquatch and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create using the Service, including email templates.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SESQUATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless Sesquatch from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
